1. About these Terms

These Terms apply to your use of our website and to any purchase you make from us. By placing an order, you accept these Terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your province or territory of residence, to purchase from our website. By placing an order, you represent that you are purchasing for personal use and not for resale.

3. Personal use, no resale

Purchases are for personal, household use only. We may refuse or cancel orders that we suspect are intended for resale or commercial distribution.

4. Products and availability

We design and sell furniture and home goods for everyday living. The assortment may include seating, tables, storage, lighting, textiles, and accessories. Some items are made to order while others are in stock. Availability, colors, and configurations can change. If an item becomes unavailable after you order, we will contact you to offer an alternative or a refund.

5. Prices, taxes and payment

All prices are in CAD and exclude applicable taxes. Applicable federal and provincial taxes (such as GST, HST, or PST, as applicable) are calculated at checkout based on the shipping address. We accept major credit cards. By submitting an order, you authorize us or our payment provider to charge your selected method for the full order amount.

6. Promotions, discount codes and gift cards

Promotions and discount codes are valid for a limited time, cannot be applied to prior purchases, and cannot be combined unless expressly stated. They have no cash value. Gift cards are non-refundable except where required by law.

7. Order acceptance

Your order is an offer to purchase. We may accept or decline it at our discretion. A contract is formed when we dispatch the products. If we cannot accept your order, we will notify you and refund any amounts charged.

8. Order limits and fraud screening

We may limit or cancel quantities per person, per household, or per order. We may verify information or require additional authorization before accepting or shipping an order. If we cancel an order after charging your card, we will refund the full amount.

9. Pricing and availability errors

We try to be accurate, but errors may occur. If we discover a pricing or availability error, we may cancel the order and refund any amounts charged, or contact you for instructions before shipping.

10. Pre-orders and backorders

Estimated shipping dates are provided at checkout for your convenience. If we are unable to ship within the estimated timeframe, we will notify you and provide a revised shipping date.

11. Shipping and delivery

Orders ship from our U.S. facility to the delivery address you provide within Canada. Estimated delivery timeframes shown at checkout are indicative only. We are not responsible for delays outside our reasonable control. Please ensure your address details are accurate.

12. Risk of loss and title

All items pass a final quality control check before leaving our facility. Title and risk of loss pass to you when the carrier collects the goods from our factory. Please inspect on delivery and report visible transport damage to the carrier at handover and to us within 48 hours so we can assist.

13. Cancellations & Returns

You can cancel within 24 hours of placing your order for a full refund. Made-to-Order items cannot be canceled after 24 hours and are not eligible for returns. See our Returns & Cancellations for details.

14. Product care and variations

Small variations in color or texture can occur between dye lots and across screens versus physical fabrics. Follow our care instructions to preserve upholstery and foam performance.

15. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data. Our total liability for any claim relating to a purchase is limited to the amount you paid for the product that gave rise to the claim.

16. Governing law and jurisdiction

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Nothing in these Terms limits any non-waivable consumer rights you may have under the law of your province or territory of residence in Canada.

17. Miscellaneous

If any part of these Terms is found invalid, the remaining parts stay in effect. Our failure to enforce a right is not a waiver. We may update these Terms from time to time. The version in force at the time of your order applies to that purchase.

18. Electronic communications

You consent to receive electronic communications related to your order, including confirmations, updates, and notices, to the email or phone number you provide. Marketing messages require separate consent and you can opt out at any time.

19. Privacy

Please see our Privacy Policy for information about how we collect, use, and protect personal data in connection with your order and use of the website.

20. Limited warranty

Unless otherwise required by applicable law, all products are provided on an "AS IS" basis without any express or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. If your product has a defect or issue, your sole and exclusive remedy is as described in our Returns & Cancellations Policy. Some provinces do not allow limitations on implied warranties or the exclusion of certain remedies, so these limitations may not apply to you. Nothing in these Terms affects any rights you may have under laws that cannot be waived.

21. Export and sanctions compliance

You represent that you are not located in a country or on a list subject to U.S. embargoes or sanctions and that you will not use the products in violation of U.S. export laws.

22. Third-party services

We may use third-party payment processors and shipping carriers. Those services are provided under their own terms and privacy policies in addition to ours.

23. Additional miscellaneous

Assignment. You may not assign or transfer your rights under these Terms without our prior written consent.

No third-party beneficiaries. These Terms do not create rights for any third party.

Severability and survival. If any provision is unenforceable, the remaining provisions remain in effect. Sections that by their nature should survive termination or expiration do survive.

Entire agreement. These Terms, together with our Returns & Cancellations Policy, Shipping Policy, and Privacy Policy, are the entire agreement regarding your purchase.
